Terms of Service

These Terms of Service ("Terms") govern your access to and use of SetForge ("we," "us," or "our"), a software-as-a-service platform available at setforge.space ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About SetForge

SetForge is a B2B fitness coaching platform that enables gym owners and personal trainers ("Coaches") to manage clients, deliver workout programs, track client progress, and leverage AI-assisted program generation. Clients of Coaches ("Clients") access the platform through an invitation from their Coach.

2. User Roles

2.1 Coaches

Coaches are subscribing users who pay for access to SetForge and are responsible for managing their clients within the platform. Coaches may invite Clients, create and assign workout programs, and use AI-powered tools to generate training content.

2.2 Clients

Clients are end users added to the platform by a Coach. Clients do not pay SetForge directly. A Client's access to the platform is contingent on their relationship with their Coach. If a Coach's subscription lapses or they remove a Client, that Client's access may be restricted or terminated.

2.3 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [info@setforge.space] if you suspect unauthorized access to your account.

3. Subscriptions and Billing

3.1 Subscription Plans

SetForge offers paid subscription plans for Coaches on a recurring monthly or annual basis. Current plan details and pricing are listed on our pricing page at setforge.space/pricing. We reserve the right to change pricing with reasonable notice.

3.2 Billing

Billing is processed through Stripe, a third-party payment processor. By subscribing, you authorize SetForge to charge your payment method on a recurring basis at the then-current rate for your selected plan. You agree to Stripe's Terms of Service in addition to these Terms.

3.3 Free Trial

If SetForge offers a free trial, it will be clearly identified at sign-up. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

3.4 Past-Due Accounts

If a payment fails, your account may enter a grace period during which limited access is maintained. If payment is not resolved within the grace period, your account may be downgraded or suspended until payment is received.

4. Cancellation

4.1 How to Cancel

Coaches may cancel their subscription at any time through their account settings or by contacting [info@setforge.space]. Cancellation takes effect at the end of the current billing period.

4.2 Effect of Cancellation

Upon cancellation, you will retain access to the Service until the end of your paid billing period. After that date, your account and your Clients' access will be deactivated. Your data will be retained for a limited period in accordance with our Privacy Policy before being deleted.

4.3 No Refunds

Subscription fees are non-refundable except where required by applicable law. Partial-period refunds are not issued for mid-cycle cancellations. See our Refund & Cancellation Policy for full details.

5. AI-Generated Content

5.1 Nature of AI Content

SetForge uses the Claude API (provided by Anthropic, PBC) to generate workout programs and related fitness content. This content is produced by an artificial intelligence model and is not reviewed by a licensed medical professional, certified personal trainer, or other qualified expert before delivery.

5.2 Not Medical Advice

AI-generated workout programs are provided for informational and fitness planning purposes only. They do not constitute medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider or certified fitness professional before beginning any exercise program, particularly if you have pre-existing health conditions, injuries, or physical limitations.

5.3 No Guarantee of Results

SetForge makes no representation that AI-generated programs will be appropriate, safe, or effective for any particular individual. Coaches are solely responsible for reviewing, adapting, and approving any AI-generated content before delivering it to Clients.

5.4 Limitation of AI Liability

SetForge is not liable for any injury, health outcome, or other consequence arising from the use of AI-generated workout programs. See Section 11 for our full limitation of liability.

6. Acceptable Use

You agree to use SetForge only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You agree not to:

• Use the Service to provide medical diagnoses or treatment recommendations
• Resell, sublicense, or otherwise commercialize access to the Service without our written consent
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Upload content that is unlawful, harmful, abusive, defamatory, or infringes the intellectual property rights of others
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Violate any applicable local, state, national, or international law or regulation

Violations of these rules may result in immediate account suspension or termination.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, available at setforge.space/legal/privacy-policy. By using the Service, you consent to the collection and use of your data as described in that policy.

8. Intellectual Property

8.1 SetForge IP

The Service, including its software, design, trademarks, and content created by SetForge, is owned by or licensed to SetForge and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use SetForge's name, trademarks, or proprietary content.

8.2 Your Content

You retain ownership of the workout programs, client data, and other content you create or upload through the Service ("Your Content"). You grant SetForge a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely as necessary to operate and provide the Service.

8.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant SetForge a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.

9. Third-Party Services

The Service integrates with third-party providers including Stripe (payment processing), Anthropic (AI content generation), and Vercel (hosting and infrastructure). Your use of the Service is subject to the relevant terms and privacy policies of these providers. SetForge is not responsible for the practices or content of third-party services.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SETFORGE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SETFORGE AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SETFORGE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SETFORGE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless SetForge and its owner, officers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

13. Termination

SetForge reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service ceases immediately.

14. Modifications to the Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you (for example, via email or an in-app notice). Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Idaho, and you consent to the personal jurisdiction of such courts.

16. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, Acceptable Use Policy, and other policies incorporated by reference, constitute the entire agreement between you and SetForge regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Failure by SetForge to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without SetForge's prior written consent. SetForge may assign its rights without restriction.
